“If It Were My House” Giveaway Rules

BROADVIEW HOMES CALGARY (“BROADVIEW”) “IF IT WERE MY HOUSE” GIVEAWAY (THE “GIVEAWAY”) IS INTENDED TO BE CONDUCTED IN THE PROVINCE OF ALBERTA ONLY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE CANADIAN LAW. NO PURCHASE IS NECESSARY. PARTICIPANTS MUST BE OF THE AGE OF MAJORITY IN THE PROVINCE OF ALBERTA OR OLDER AT THE TIME OF ENTRY. VOID IN WHOLE OR PART WHERE PROHIBITED BY LAW. ENTRY IN THIS GIVEAWAY CONSTITUTES ACCEPTANCE OF THESE GIVEAWAY RULES (THE “GIVEAWAY RULES”)

ELIGIBILITY.

  • To be eligible for this Giveaway, an individual must:
    • Be a legal resident of the province of Alberta; and
    • Be of the age of majority in the Province of Alberta or older at the time of entry.

Employees of Broadview Homes are not eligible to participate in the giveaway.

GIVEAWAY PERIOD

The giveaway will start on October 17th and the final winner will be selected by December 19, 2023 and each giveaway period will close 11:59pm on the Monday evening of each week. The giveaway will close December 11th, and no further entries shall be accepted.

HOW TO ENTER THE “IF IT WERE MY HOUSE” GIVEAWAY ON INSTAGRAM

  1. There is no purchase necessary to enter the giveaway.
  2. Follow Broadview Homes Calgary @broadviewhomesyyc on Instagram.
  3. Tag 3 friends in the comments section of the weekly giveaway post.
  4. All entries become the sole property of Broadview Homes and none will be returned for any reason. Entries must be received no later than the end of the giveaway period. Entries will be declared invalid if they are late, incomplete, garbled, electronically reproduced or deemed invalid by Broadview Homes.
  5. Proof of identification will be required by the prize winner prior to prize disbursement.
HOW TO ENTER ON THE “IF IT WERE MY HOUSE” GIVEAWAY IN PERSON
  1. There is no purchase necessary to enter the giveaway.
  2. Visit a Broadview Home Calgary Showhome, addresses are listed at Homes - Broadview Calgary Homes (broadviewhomescalgary.com).
  3. Find the ‘Golden Leaf’ poster hidden within the Showhome.
  4. Scan the QR code on the ‘Golden Leaf’ poster using their mobile device.
  5. Fill out the all required entry information.
  6. All entries become the sole property of Broadview and none will be returned for any reason. Entries must be received no later than the end of the giveaway period. Entries will be declared invalid if they are late, incomplete, garbled or deemed invalid by Broadview.
  7. Proof of identification will be required by the prize winner prior to prize disbursement.

PRIZE

  • There are (8) prizes (“Prizes”) available to be won by the Prize winner (the “Winner”) consisting of a Dyson Vacuum, Traeger Grill, Vitamix, $1000 Blue Grass Gift Card, Fire Table, Ooni Pizza Oven, Jura Coffee System, and Sonos Speakers. Actual models of the prizes may vary and are to be selected/purchased at the discretion of Broadview dependent on the availability at the time of purchase.
  • Once the winner has been successfully contacted and notified of his/her/their prize and fulfilled the requirements set out herein, Broadview will contact the winner to coordinate the prize pick up details and an estimated timeline of when the prize will be available for pick up. Once available, the prize will be available for pick-up at a Broadview's Showhome or head office, to be arranged with prize winner.
  • Prize must be accepted as awarded and cannot be transferred, assigned, except at the sole discretion of Broadview.
  • Broadview shall not assume any liability if the prize is lost, damaged, faulty, or misdirected.

WINNER SELECTION

One (1) Winner shall be selected as follows:

  • On or after the giveaway period, one (1) entrants will be selected by a random draw from all eligible entries received during the giveaway period. The odds of being selected as a potential winner are dependent upon the number of eligible entries received by Broadview.
  • THE SELECTED ENTRANT WILL BE NOTIFIED BY EMAIL, INSTAGRAM AND/OR PHONE NO LATER THAN 7 BUSINESS DAYS AFTER THE GIVEAWAY PERIOD HAS ENDED AND MUST RESPOND WITHIN TWO (2) BUSINESS DAYS OF NOTIFICATION. Upon notification, the selected entrant must respond by telephone or email to the giveaway number or email address provided in the notification, and the selected entrant’s response must be received by Broadview within two (2) business days of such notification. If the selected entrant does not respond in accordance with the giveaway rules, he/she will be disqualified and will not receive the prize and another entrant may be selected in Broadview’s sole discretion until such time as an entrant satisfies the terms set out herein. Broadview is not responsible for the failure for any reason whatsoever of a selected entrant to receive notification or for Broadview to receive a selected entrant’s response.
  • If, as a result of an error relating to the entry process, drawing or any other aspect of the giveaway, there are more selected entrants than contemplated in these giveaway rules, there will be a random draw amongst all eligible prize claimants after the giveaway’s closing date to award the prize.

INDEMNIFICATION BY ENTRANT

By entering the giveaway, entrant releases and holds Releasees harmless from any and all liability for any injuries, loss or damage of any kind to the entrant or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the prize, participation in the giveaway, any breach of the giveaway rules, or in any prize-related activity. The entrant agrees to fully indemnify Releasees from any and all claims by third parties relating to the giveaway, without limitation.

LIMITATION OF LIABILITY

Broadview assumes no responsibility or liability for lost, late, falsified, misdirected or incomplete entries, notifications, responses, replies or any Release, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an entry. Broadview is not responsible for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the giveaway or by any technical or human error which may occur in the administration of the giveaway. Broadview assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Broadview is not responsible for any problems, failures or technical malfunction of any telephone network or lines, computer online systems, servers, providers, computer equipment, software, e-mail, players, or browsers, on account of technical problems or traffic congestion on the Internet, at any website, or on account of any combination of the foregoing or otherwise. Broadview is not responsible for any injury or damage to entrant or to any computer related to or resulting from participating or downloading materials in this giveaway. Entrant assumes liability for injuries caused or claimed to be caused by participating in the giveaway, or by the acceptance, possession, use of, or failure to receive the prize. Broadview assumes no responsibility or liability in the event that the giveaway cannot be conducted as planned for any reason, including those reasons beyond the control of Broadview, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of this giveaway.

CONDUCT

By participating in the giveaway, each entrant agrees to be bound by the giveaway rules, which will be posted at the giveaway website/Instagram and made available throughout the giveaway period. Entrant further agrees to be bound by the decisions of Broadview, which shall be final and binding in all respects. Broadview reserves the right, in their sole discretion, to disqualify any entrant found to be:

  1. Violating the giveaway rules;
  2. Tampering or attempting to tamper with the entry process or the operation of the giveaway and/or the giveaway website/Instagram;
  3. Violating the terms of service, conditions of use and/or general rules or guidelines of any Qualico property or service; and/or
  4. Acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE GIVEAWAY WEBSITE OR ANY RELATED WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE GIVEAWAY MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THEY RESERVE THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION.

 PRIVACY / USE OF PERSONAL INFORMATION

  1. By participating in the giveaway, entrant:
    1. Grants Broadview the right to use his/her name, mailing address, telephone number, and email address (“Personal Information”) for the purpose of administering the giveaway, including but not limited to contacting and announcing the Winner;
    2. Grants Broadview the right to use his/her Personal Information for publicity and promotional purposes relating to the giveaway, in any and all media now known or hereafter devised, without further compensation unless prohibited by law; and
  • Acknowledges that Broadview may disclose his/her/their Personal Information to third-party agents and service providers in connection with any of the activities listed in (i) and (ii) above.
  1. Broadview will use the entrant’s Personal Information only for identified purposes, and protect the entrant’s Personal Information in a manner that is consistent with Qualico’s Privacy Policy at: qualico.com

INTELLECTUAL PROPERTY

All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations are owned by Broadview and/or their affiliates. All rights are reserved. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.

TERMINATION

Broadview reserves the right, in their sole discretion, to terminate the giveaway, in whole or in part, and/or modify, amend or suspend the giveaway, and/or the giveaway rules in any way, at any time, for any reason without prior notice.

LAW

These are the official giveaway rules. The giveaway is subject to applicable federal, provincial and municipal laws and regulations. The giveaway rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over Broadview. All issues and questions concerning the construction, validity, interpretation and enforceability of the giveaway rules or the rights and obligations as between the entrant and Broadview in connection with the giveaway shall be governed by and construed in accordance with the laws of the province of Alberta including procedural provisions without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.

LANGUAGE DISCREPANCY

In the event of any discrepancy or inconsistency between the terms and conditions of the giveaway rules and disclosures or other statements contained in any giveaway-related materials, including but not limited to the giveaway entry form, or point of sale, television, print or online advertising, the terms and conditions of the giveaway rules shall prevail, govern and control.
